These Terms of Service (the “Terms”) are a binding agreement between you and the operator of the StreamSona service (“StreamSona,” “we,” “us,” or “our”) governing your access to and use of the StreamSona websites, applications, and related services (collectively, the “Platform”). By creating an account, purchasing credits or a subscription, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
These Terms incorporate by reference our Acceptable Use Policy, Privacy Policy, and Refund & Cancellation Policy. A violation of the Acceptable Use Policy is a violation of these Terms. These Terms are provided in English; any translation is for convenience only and the English version controls.
1. The Platform
StreamSona lets you drive a virtual persona in real time: your camera and microphone input, uploaded character images, and prompts or settings you provide (“Input”) are processed by artificial-intelligence models to produce transformed video and images (“Output”). Input and Output are together your “Content.”
2. Eligibility — 18+
The Platform is available only to individuals who are at least 18 years old (or the age of majority in your jurisdiction, if higher) and who can form a binding contract. By using the Platform you represent that you meet these requirements. We may suspend or terminate, without refund, any account that we believe belongs to a person under 18, and we may require proof of age at any time.
3. Your account
You must register with accurate information and keep it current. You are responsible for everything that happens under your account and for keeping your login credentials secure. Notify us immediately at support@streamsona.com if you suspect unauthorized use of your account. Accounts are personal to you and may not be sold, shared, or transferred.
4. Payments, credits, and subscriptions
- Prices and plans are described on our pricing page. Usage is metered in credits at the rates shown on the pricing page, measured by verified server time.
- Credit consumption rates reflect our underlying model and infrastructure costs and may change from time to time. Changes take effect prospectively after we post the updated rates on the pricing page — and, for changes that materially increase consumption rates, after notice through the Platform or by email — and apply to usage after the effective date, including usage of previously purchased credits.
- Credits have no cash value, are not transferable, and are not redeemable for money. All purchases are final and non-refundable, except as expressly stated in the Refund & Cancellation Policy or required by applicable law.
- Credits included with a subscription are valid for the billing period in which they are granted (one month for monthly plans, one year for annual plans) and expire, without refund or credit, at the end of that period. One-time top-up credits do not expire while your account remains in good standing.
- Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your billing page; cancellation takes effect at the end of the current period.
- If a payment fails or is reversed, we may suspend or limit your access until the balance is settled. Payments are processed by third-party payment providers; we do not store your card details.
- We may change prices or plan structures prospectively. Changes do not affect a billing period you have already paid for.
5. Your Content and your responsibility
You retain ownership of your Input. Subject to your compliance with these Terms, we assign to you all our right, title, and interest, if any, in the Output generated for you, and you may use it for any lawful purpose, including commercial use.
You are solely responsible for your Content. You represent and warrant that:
- you own or have all rights, licenses, releases, and consents needed for your Input, including the verifiable consent of any real, identifiable person whose face, likeness, voice, or personal data appears in it;
- your Content and your use of the Platform comply with applicable law, these Terms, and the Acceptable Use Policy; and
- where your Input contains personal data of others, you have a lawful basis to process it and you comply with applicable data-protection law (including, where applicable, the GDPR).
Because outputs are generated by AI models, similar or identical outputs may be produced for other users, and Output may be inaccurate, incomplete, or otherwise flawed. You are responsible for reviewing Output before relying on it or publishing it. We are not responsible for how you or your audience use Output.
You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your Content solely as needed to operate, secure, troubleshoot, and improve the Platform and to comply with law. We do not use your camera or microphone streams to train AI models.
6. Monitoring and enforcement
We may, but are not obligated to, monitor, review, or moderate Content or use of the Platform. We may remove or refuse to process any Content, and may suspend or terminate any account, at any time and without prior notice, if we believe in good faith that Content or conduct violates these Terms, the Acceptable Use Policy, or applicable law, or creates risk for us, other users, or third parties. We may access, preserve, and disclose information as described in the Privacy Policy, including to comply with law, respond to lawful requests, enforce these Terms, or protect the rights, property, or safety of any person. Where the law requires it — including in cases involving child sexual abuse or exploitation material — we will report to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement.
7. Intellectual property
The Platform, including its software, models, interfaces, designs, text, and trademarks (the “Materials”), is owned by us or our licensors and is protected by intellectual-property laws. Except for the rights expressly granted to you in these Terms, no rights in the Materials are granted. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Materials, or use them to develop or improve any competing product or any machine-learning model.
If you send us feedback or suggestions, we may use them without restriction or compensation to you.
8. Copyright complaints (DMCA)
If you believe content on the Platform infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) — identification of the work, the location of the allegedly infringing material, your contact information, good-faith and accuracy statements, and your physical or electronic signature — to support@streamsona.com. If your material was removed by mistake, you may submit a counter-notification to the same address. We terminate the accounts of repeat infringers. Knowingly false notices may create liability under 17 U.S.C. § 512(f).
9. Third-party services
The Platform relies on third-party services (for example sign-in providers, payment processing, hosting, and AI model providers) and may link to third-party sites or interoperate with third-party software such as streaming tools. We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.
10. Disclaimers
THE PLATFORM AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. YOU ACKNOWLEDGE THAT AI SYSTEMS MAY PRODUCE OUTPUT THAT IS INACCURATE, BIASED, OFFENSIVE, OR OTHERWISE INAPPROPRIATE, AND THAT YOUR USE OF THE PLATFORM AND OUTPUT IS AT YOUR OWN RISK. THE PLATFORM DOES NOT PROVIDE PROFESSIONAL ADVICE OF ANY KIND.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW, INCLUDING FOR FRAUD OR FOR STATUTORY CONSUMER RIGHTS THAT CANNOT BE WAIVED.
12. Indemnification
You will defend, indemnify, and hold harmless StreamSona and its operators, affiliates, and personnel from and against any claims, damages, fines, penalties, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your Content; (b) your use of the Platform; (c) your violation of these Terms or the Acceptable Use Policy; (d) your violation of applicable law; or (e) your violation of any third party’s rights, including intellectual-property, privacy, or publicity rights.
13. Suspension and termination
We may suspend or terminate your access to the Platform at any time, with or without cause or notice. If your account is terminated for a violation of these Terms or the Acceptable Use Policy, remaining credits and prepaid fees are forfeited and are not refunded. You may stop using the Platform and cancel your subscription at any time. Sections 5–8 and 10–16 survive termination.
14. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above reflects the current version. For material changes we will give notice by email or through the Platform before the changes take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
15. Governing law; disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles, except where the mandatory consumer-protection law of your country of residence applies and cannot be contracted away. The state and federal courts located in Delaware have exclusive jurisdiction over disputes arising out of these Terms or the Platform, and each party consents to personal jurisdiction there; either party may instead bring an individual claim in small-claims court where permitted.
To the maximum extent permitted by law, you and StreamSona each waive the right to a jury trial and the right to participate in a class action, class arbitration, or other representative proceeding. Any claim must be brought within one (1) year after it accrues, or it is permanently barred, except where a longer period is required by law.
16. General
These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Platform. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, employment, or agency relationship.
